1. Acceptance of terms

Welcome to the National Custom and Self Build Association’s websites. These include The Self Build Portal (including the Right to Build Portal, NaCSBA’s member website and The Right to Build Toolkit, the website for the Right to Build Task Force. These websites have been created by the National Custom & Self Build Association (NaCSBA).

To use these websites you must accept these Terms and Conditions (“the Terms”). If you do not wish to be bound by them you should exit the websites immediately.

These terms and conditions govern the visitors’ use of the websites and their relationship with NaCSBA (“NaCSBA” also includes the Right to Build Task Force).

NaCSBA reserves the right to amend the Terms at any time, and may change the terms without specific notice to you. The latest terms will be posted at www.nacsba.org.uk and should always be reviewed by you prior to use of the site. For compliance with GDPR, all old versions of the Terms will be recorded, with dates they were valid, so we can establish exactly which version people signed up under.

These websites belongs to NaCSBA (registered number 7815926), registered in England and Wales, whose registered office is at Normandy House, 305-309 High Street, Cheltenham, GL50 3HW. NaCSBA is a non profit making limited company and the liability of members is limited to £1. VAT registration number GB 122 2385 49

2. NaCSBA Supporters

By registering your details with any of the Self Build Portal, NaCSBA or Right to Build Toolkit sites at www.nacsba.org.uk, you will automatically be enrolled at individual supporter level to NaCSBA. Supportership and membership helps support our work developing custom and self-build in the United Kingdom.

By providing information through any of our websites or by accepting Cookies, NaCSBA will store and process this information in accordance with its Privacy Policy and Cookie Policy. This forms part of these Terms and Conditions, and by using our websites you acknowledge and agree that you have read and accept the terms of the Privacy Policy and the Cookie Policy.

Much of the content on the Self Build Portal, NaCSBA’s member sites and the Right To Build Toolkit is free to use, or free for registered users. Membership of NaCSBA is available for professionals on several levels, details can be found here https://www.nacsba.org.uk/membership

3. Intellectual Property

All materials which form part of these websites, their underlying structures or content from time to time are subject to copyright. Permission is granted to copy electronically and print in hard copy any material appearing on the publicly accessible areas of the websites on condition that the material is used only for purely personal or educational activities which do not have a commercial purpose.

Other than accessing the websites for your own informational not for profit purposes and downloading certain permitted items (subject to any additional on-screen restrictions), you may not use, copy, download, reproduce, modify or transmit all or any part of any such materials. Any use of these websites, their content or underlying structures is subject to these terms and conditions. Any unauthorised use of these websites or any such materials may constitute an offence under the Computer Misuse Act 1990.

Downloading is done at your sole risk.

4. Warranties and Liability

Information provided on the websites is intended to provide general information on matters of interest only, and you use it at your own risk. The information does not constitute accounting, financial, consulting, investment, legal or any other professional advice. You are advised to consult a professional adviser should you require such information or advice, especially in connection to local laws.

NaCSBA will use reasonable efforts to ensure but does not warrant that information or content contained on the websites is accurate and up to date. NaCSBA does not warrant that the operation of the websites or any facilities contained on or accessed via it will be secure, continuous or error-free. All implied warranties, terms or conditions are expressly excluded to the maximum extent permitted by law.

NaCSBA shall have no liability to any user of these websites, or third-party websites, content or material, or any other person for any claim, indirect or consequential loss or damage arising out of or relating to the use of all or any part of these website, its content or structure or reliance on information contained on it whether under contract, tort (including negligence), breach of statutory duty or otherwise (other than in relation to death, personal injury or fraud). We do not accept liability for any errors and/or omissions and reserve the right to change any of the information found at this site at any time without notice.

5. Third Parties

These websites may contain links or references to other third party websites, including products and services, from time to time. Such sites are operated by third parties and are not under the control of NaCSBA.

The existence of such links does not imply any affiliation or association between NaCSBA and the third party nor any endorsement of any third party product. NaCSBA accepts no responsibility in relation to such links or third party sites and makes no representations, guarantees or warranties in relation to the third party, the quality of the websites or the accuracy of, title to or otherwise in relation to the information contained thereon. Nor is it responsible for any agreement or understanding you enter into with a third party in relation to any products or service.

6. Governing Law

Use of these websites is governed by and will be construed in accordance with the laws of England. You irrevocably submit to the non-exclusive jurisdiction of the English Courts.

7. Personal Information and GDPR

How we contact you is dictated by law under GDPR, ePrivacy and PECR. Since the 25 May 2018 new General Data Protection Regulations are in force across Europe, governing how we process your data.

We will use any personal information you give us to operate these websites and enhance our services to you. We may also contact you by email, post or otherwise from time to time with information concerning additional materials, products, ticket offers or services which may be of interest to you.

Self Build Portal registered users – we process your data under the basis of Legitimate Interest, and you have the legal right to object to this. You can let us know by email at media@nacsba.org.uk and you’re also able to unsubscribe from any communications by the link in the footer.

A list of third-party companies that may contact Self Build Portal users can be found on NaCSBA’s Membership Directory – however you will be contacted by NaCSBA – your data will not be shared with these members.

We use “cookies” when you access our websites. Cookies are small bits of code, which are usually stored on your computer’s hard drive, designed to enable the websites to operate more efficiently and which may store your personal information (depending on your computer facilities). 8. Content submitted to the website

Information, data, text, photographs, graphics, video, messages or other materials, known as content, may be posted or uploaded (in public or privately) on to designated areas of some NaCSBA sites. NaCSBA does not control the Content and, as such, is not responsible for it in any way whatsoever.

In particular, NaCSBA does not guarantee the accuracy, integrity or quality of such Content. NaCSBA shall have the right (but not the obligation) in its sole discretion to delete, edit, lock, move or remove any Content without notice. Without limiting the foregoing, NaCSBA shall have the right without notice to record the IP address from which any Content is posted or uploaded to or otherwise transmitted through any NaCSBA Site or Server and to lock or remove any Content which violates these Terms and Conditions or is or may be irrelevant, out of date, inappropriate or objectionable in any way whatsoever or in respect of which NaCSBA receives any complaint (whether valid, justified or not).

If you upload, post or otherwise transmit any Content to a public part of any NaCSBA Site or Server (including, without limitation, if you post a message to a bulletin board, upload files, input data, or engage in any other form of communication through any NaCSBA Site) you are wholly responsible for it.

You hereby: (a) grant NaCSBA and its group companies an irrevocable, perpetual, royalty-¬free right to use, distribute, copy, edit, adapt, license, distribute, transmit, publish, publicly perform or display any such Content in any form or medium anywhere in the World; and (b) irrevocably and unconditionally waive any moral rights or similar rights you have in any Content pursuant to the Copyright, Designs and Patents Act 1988 (as amended, superseded or replaced from time to time) (the “Act”) or equivalent legislation anywhere in the World.

9. Member and supporter user conduct

You agree that when using the Website or any other NaCSBA Sites you will not: (a) Upload, post or otherwise transmit Content which violates the rights (including, without limitation, the intellectual property rights) of a third party or which is unlawful, harmful, threatening, abusive, argumentative, hateful, offensive (whether in relation to sex, race, religion or otherwise) harassing, defamatory, vulgar, obscene, indecent, libellous, invasive of another’s privacy or contains any illegal content; (b) Harvest Content or IP addresses or upload, post or otherwise transmit any Content which contains software viruses or any other files or programs that may interrupt, destroy or limit the functionality of this Website or any other NaCSBA Site or Server or any networks connected to this Website or another’s computer, or that contains any chain letters, pyramid­selling schemes, bulk mail, junk mail or similar; or (c) Upload, post or otherwise transmit any Content for any commercial or business purpose including (without limitation) any Content which contains any advertising or promotional materials; or (d) Restrict or in any way inhibit any person from using this Website or any other NaCSBA Site; (e) Upload, post or otherwise transmit any Content which is unnecessary and/or repetitive including any Content which repeats that previously uploaded, posted or transmitted by you or another visitor, unless absolutely necessary; or (f) Upload, post or otherwise transmit any Content to a part of this Website or any other NaCSBA Site which is irrelevant to the subject matter or the Content; or (g) Upload, post or otherwise transmit any Content to this Website or any NaCSBA Site or Server using an e­mail address provided by a free account service such as Yahoo; or (h) Register yourself as a member of this Website or the forum provided through this Website or any NaCSBA Site, or to receive any newsletter or other service under more than one user name and/or user account number without the consent of the Website editor or the forum moderator; or (i) Use this Website or any other NaCSBA Site in a manner that is inconsistent with these Terms and Conditions and/or any relevant laws and regulations in force from time to time; or (j) Breach the terms of any suspension or ban or seek alternative access.

You acknowledge that you are solely responsible for maintaining a secure password for the purpose of gaining access to the member sections of this Website or any other NaCSBA. You agree to indemnify NaCSBA in full and on demand from and against any loss (economic or of goodwill), damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of this Website or any other NaCSBA sites other than in accordance with these Terms and Conditions.

Further, users may not publish content that encourages behaviour that may constitute a criminal offence, result in civil liability or otherwise violate any applicable local, state, national or international law or regulation. Whilst NaCSBA’s websites aims to moderate all content, the websites do not guarantee that offensive or inappropriate material will be immediately removed or deleted from the website. Failure by the websites to remove or delete offensive or inappropriate content does not waive our right, but not the obligation, to remove, edit or delete offensive or inappropriate content in subsequent or similar cases, without notification.

10. Membership Directory (Self Build Portal)

The suppliers listed in the Directory are members of NaCSBA and as such are organisations that actively support the self/custom build sector, and have signed up to NaCSBA’s Code of Practice. This means that that you can trust them to support your self-build dream as a company or body. NaCSBA will not be held responsible for the content that is held on any third party websites listed.

If you choose to answer ‘Yes’ to the question “Are you a NaCSBA member?” when submitting information via the Listing Entry, your NaCSBA membership will be subsequently verified before publication of your listing. If, upon verification, you are found not to be a NaCSBA member, you will be liable to receive an invoice for a full year’s corporate membership.

Please note, once paid, membership to NaCSBA is non-refundable.

Moderators reserve the right to decide which entries should and should not be published.

Submissions to “the Forum” must be: Be accurate (where they state facts); comply with applicable law in the UK and in any country from which they are posted.; be relevant to the forum topic; not include personal comment or gossip; must not infringe any copyright, database right or trade mark of any other person; must not be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; must not be used to impersonate any person, or to misrepresent your identity or affiliation with any person or give the impression that they emanate from the Task Force, if this is not the case.
Failure to comply with this acceptable use policy for “the Forum” constitutes a material breach of the terms of use upon which you are permitted to use the forum, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
    Issue of a warning to you.
  • Legal proceedings against You for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
    Further legal action against you.
    Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
    Should your access to the Right to Build Toolkit website or forum be terminated or suspended due to non-compliance in regards to this policy, any subscriptions thus far paid will not be reimbursed.

11. Accessibility

We’re committed to making our websites as accessible to as many people as possible. To that end we endeavour to label all images for those that use screen readers. There may be some areas of our websites where there is a barrier to accessibility but we are not yet aware of it.

12. Changes to the this policy

We may revise this acceptable use policy at any time.
You should not reproduce duplicate, copy or re-sell any part of the Right to Build Toolkit or any NaCSBA website or forum in contravention of the provisions of our terms of use
